Expert Insight

A High Court judge has sent tremors through Britain's shopping centres with a ruling on credit card interchange fees that has baffled retailers who are confronted with conflicting judgments. In recent years the courts have been dealing with several cases against credit card companies over the dreaded interchange fees. Those cases were jeopardised when Mr Justice Popplewell contradicted the findings of an earlier UK Competition Appeal Tribunal decision. In stark contrast with the tribunal, the judge found that the fees were lawful. Unless the judgments are dealt with together, the risk of continued confusion remains high.
