As the market for private wealth becomes increasingly global, Taylor Wessing is one of only a handful of firms with a powerful international Private Client presence. We have experts in Europe, South-east Asia and the Middle East and our international team comprises more than 50 lawyers, including 23 partners.

We have a fast-growing client base and provide the high-quality and discreet service our clients expect. We are very experienced in advising international families, family offices, private banks and fiduciary groups and provide market-leading expertise in international and domestic trusts and estates. We are particularly adept with multi-jurisdictional tax and inheritance issues as well as international asset structuring, and provide a high-quality service on both contentious and non-contentious matters.

While much of our work is technically complex our lawyers are regularly commended by clients for their communication skills, their commercial approach and their pragmatism. Our ethos has always been to build a close and lasting relationship with clients. The Private Client team is also an important part of Taylor Wessing’s cross-departmental International Private Wealth group.     The enjoyment and protection of precious works of art remains central to the lives of many private clients, and we advise a wide range of clients in relation to art and heritage property. They include artists and the families of deceased artists, but also galleries, foundations and collectors on the purchase, ownership, taxation and protection of works of art. Our team will also work in conjunction with the firm’s intellectual property department and in particular our copyright experts in this field. Our practice also covers the buying, owning and selling of other high-value assets – or “trophy assets” – including items such as classic cars, antiquarian books, diamonds and precious gems, bloodstock, and private jets and super-yachts.

    We advise across all aspects of charity and trust law, particularly on issues relating to the formation and governance of charities, not-for-profit organisations, social enterprises and private trusts. Our practice covers the establishment of new charities by businesses, livery companies and families, and subsequent advice on all aspects of their administration, operations, taxation and dealings with the charity commissions.

  • Disputes in family businesses

    Disputes between the shareholders of family-controlled businesses occur frequently and are often caused by differing personal and family interests, or by different opinions regarding business decisions. Such disputes not only strain the relationships between the shareholders but, since family members often manage the businesses, they can interfere with important business decisions.
    We have extensive experience in handling such conflicts and advising shareholders of family-controlled businesses on establishing suitable dispute resolution mechanisms before a conflict arises as well as in conflict situations. These include implementing alternative forms of dispute resolution such as mediation.

  • Domestic, international estates & inheritance

    We advise individuals and families on their estate planning. This begins with a thorough understanding of the individual’s/family’s objectives and goals, together with an in-depth analysis of their current asset structuring. Implementing the intended succession typically involves tax planning, structuring and drafting wills, and contracts of inheritance. In addition we advise heirs through complex inheritance and probate issues and represent them in out-of-court disputes, as well as in court proceedings.
    Today, it is common that members of a family have residences in several different countries and regions. Owning assets in different countries around the world can greatly complicate the probate and succession process. Our lawyers are proficient in international probate issues, the drafting of wills and inheritance contracts within diverse jurisdictions, and the interplay between the succession laws of involved countries. We aim, through asset protection structures, to avoid the difficulties that can arise through probate procedures in different countries.

    Of prime importance to any tax motivated structure is a clear understanding of the client’s tax status. Our Private Client lawyers provide an in-depth analysis of a client’s domicile and residence status. This analysis is supplemented, where necessary, by detailed correspondence with the relevant sections of the relevant tax authority, such as the UK’s HM Revenue & Customs.     Executors are key to securing an efficient succession. To fulfil the tasks, duties and responsibilities of an executor requires deep insight into the family sphere as well as a certain level of understanding of the estate and its implications. We are trusted executors over the estates of our clients and also control commercial investments as executors.     For many entrepreneurs and families the use of trusts, settlements and foundations (established onshore or offshore) lies at the heart of tax planning, asset protection, and/or the long-term preservation of family-owned businesses. The uses of trusts and settlements are many and varied and they continue to provide excellent asset protection and tax planning opportunities (in the UK in particular) for clients from countries other than the UK, even those whose own legal system does not recognise trusts. Trusts also provide opportunities for UK clients holding long-term investments to maximise relief from UK capital gains tax.
